Helping property owners maintain safe sidewalks 

The Sidewalk Repair Program helps eligible homeowners repair or replace hazardous sidewalks adjacent to their property. The program improves safety, accessibility and public welfare throughout the community. 

Under Section 6-2012 of the Commerce City Revised Municipal Code, property owners are responsible for maintaining sidewalks next to their property and keeping them hazard-free. This program helps eligible residents address qualifying sidewalk issues through a city-managed repair program and cost-sharing assistance. The program begins in 2026 and will operate annually, subject to available funding.

The Sidewalk Repair Program recognizes the importance of safe, accessible, and well-maintained infrastructure. This program and the allocated funding will help enhance mobility, quality of life for residents, and safety improvements across the community.

Apply for the Sidewalk Repair Program

2026 Application Window: 

May 1 – June 30

General Interest Form can be submitted: 

  • Online through the city application portal
    • General interest form can be found below.
  • In-person at the Municipal Service Center, 8602 Rosemary St.

If funding is exhausted before June 30, the application portal may close early. 

How the Sidewalk Program Works

1) Submit a General Interest Form

  •  Property owners submit an general interest form with required documentation to start the application process. during the annual application window with required documentation.
  • After a general interest form is submitted, a staff member from Public Works will contact you within two weeks regarding next steps.

2) General Interest Form Review

  • Applications are reviewed in the order they are received to determine eligibility.

3) Submit Further Application Information

  • Once initial reviews are completed from the general interest form, applicants will be contacted to add their income verification through a secure portal and link.   

4) Inspection

  • Staff members or City hired contractors will enter their inspection request and permit through the eTrakit portal
  • City staff will inspect the sidewalk to confirm that it meets program criteria.

5) Cost Share

  • Property owners contribute their portion of the repair cost unless a qualifying waiver applies.
  • During the process, a staff member will be in contact regarding the payment process. Homeowners can pay via Credit Card or Cash at the Civic Center, 7887 E 60th Ave. or mail-in/deliver a check payment to the Municipal Services Center, 8602 Rosemary St.

6) Repairs Scheduled

  • Approved repairs are scheduled and completed by the city or a city contractor.

7) Repairing Commences

  •  Once all steps 1-6 have been completed, repairing of the identified sidewalk may commence!

Program Funding 

The Sidewalk Repair Program will begin in 2026 with $100,000 in city funding. Funding levels for future years will be considered through the city’s annual budget process. Repairs are completed by the City of Commerce City or an approved city contractor as directed by the Public Works Department.

Cost Share

The Sidewalk Repair Program operates using a 50/50 cost share. 

  • The City of Commerce City pays 50% of the repair cost.
  • The property owner pays the remaining 50%.

Income-Based Cost Waiver

Homeowners whose household income is below 80% of the Area Median Income (AMI) may qualify for a waiver of the homeowner cost share. Income levels are determined by the U.S. Department of Housing and Urban Development (HUD). Applicants requesting a waiver must provide documentation verifying household income through the City’s secure portal.

Eligibility Requirements

To qualify for the program, the property and sidewalk must meet the following criteria. 

Property Type

Eligible properties include:

  • Single-family detached homes 
  • Single-family attached homes

The property must be located within Commerce City limits and have a sidewalk adjacent to the city right-of-way.

Sidewalk Condition

The sidewalk must be identified by city staff as hazardous or non-compliant.

Eligible sidewalks include:

  • Uneven sidewalk slabs
  • Cracks affecting accessible use
  • Raised sections creating a trip hazard
  • Deteriorated or damaged concrete

Important Notice: Tree Root Damage 

If your sidewalk damage is caused by tree roots or another code-related issue, that condition must be corrected before the City can move forward with sidewalk repairs. Property owners are responsible for addressing these underlying issues. 

Please note: The City is only responsible for sidewalk repairs that have been approved and accepted into the program. Costs associated with correcting tree root damage or other code violations are not covered.

Public Works staff will offer an alternative repair for sidewalks with tree root damage. Best practice would be to address the tree root issues on the homeowner’s property before applying for this sidewalk repair program.

Types of Repairs Offered

Grinding Concrete: This type of repair will be used when there is a minor “lip” that is not level to the coinciding concrete panel. City staff will go out to simply level it out using a grinder.

Cold-Mix Asphalt Patch: This type of repair will be used when griding the concrete would not solve the hazard on the sidewalk. Additionally, this option is used when tree roots are invading the sidewalk causing uplifting, shifting, or deterioration of the sidewalk. For this option, the 50/50 cost-share program will still be applicable to the homeowner.

Concrete Panel: This type of repair will be offered to homeowners when the two other options will not resolve the sidewalk hazard. This process will include a “like-for-like" panel to repair the sidewalk. For this option, the 50/50 cost-share portion of the program will still be applicable to the homeowner.

 

Property Compliance

Before repairs can begin:

  • The property must be free of other city code violations.
  • All city taxes must be current.

If violations exist, the property owner will have 30 days after program acceptance to resolve them. Failure to resolve violations will remove the project from that year’s repair list.

Application Requirements

Applications must include the following:

  • Financial Verification
  • Property address
  • Proof of ownership
  • Photos showing the sidewalk condition
  • Signed permission allowing the city or contractors to access the property
  • Income verification if eligible for a waiver

Applications missing required documentation will be considered incomplete and void.

Program Prioritization

Applications are processed first come, first served. If funding runs out before June 30:

  • The application portal will close.
  • Eligible applications may be prioritized in the following year’s funding cycle.

Applications rejected due to unrelated code violations will not carry over. 

Code Violation Exceptions

If a sidewalk hazard is identified as a code violation, an application may be submitted at any time during the calendar year. These applications will be placed on the list for the next available funding cycle. If the sidewalk issue is caused by another violation, such as damage from a privately owned tree; the city is not responsible for correcting the underlying violation. 

Public Works may allow exceptions in certain situations, such as when the tree is located within a tree lawn.
