MINUTES REGULAR MEETING OF COMMERCE CITY COUNCIL July 21, 2008
CALL TO ORDER
A regular meeting of the City Council of the City of Commerce City was called to order by Mayor Paul Natale on July 21, 2008, at 7:08 p.m. ROLL CALL Present: Mayor Natale- presiding Mayor Pro-Tem Jaquith Councilman Benson Councilwoman Drotar Councilman Johnson Councilman Lewis Councilman McEldowney Councilwoman Snyder Councilwoman Teter Staff Reporting: City Attorney Robert Gehler City Manager Jerry Flannery PLEDGE OF ALLEGIANCE

Kids Helping Kids
Peter Montoya, and other participants in the Kids Helping Kids program, provided Council with a brief description of the program and a listing of their accomplishments and goals. APPROVAL OF MINUTES
Council members McEldowney and Johnson moved and seconded allowing Councilwoman Teter to abstain from voting on the minutes of the regular meeting of July 7, 2008, because of her excused absence. CITIZEN COMMUNICATION
Glen Murray, 11010 Havana St., addressed Council regarding vandalism that occurred on his property recently. CONSENT AGENDA Council members Johnson and McEldowney moved and seconded approving the consent agenda as presented.
City Attorney Bob Gehler read the title of Ordinance 1735: AN ORDINANCE AMENDING THE 2008 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO BY THE RECOGNITION OF THE ADAMS COUNTY OPEN SPACE GRANT IN THE AMOUNT OF $504,800 TO BE USED FOR THE FIRST PHASE OF FENCING AND TRAIL AMENITIES THAT WILL CONNECT THE NORTHERN AND SOUTHERN PORTIONS OF THE CITY, HIGHWAY 2 FROM 72ND AVENUE TO 96TH AVENUE AND ALONG 96TH AVENUE FROM HIGHWAY 2 TO BUCKLEY ROAD AND AUTHORIZATION OF THE EXPENDITURE THEREOF
City Attorney Bob Gehler read the title of Ordinance 1736: AN ORDINANCE AMENDING THE 2008 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO BY THE RECOGNITION OF THE ADAMS COUNTY OPEN SPACE GRANT IN THE AMOUNT OF $27,691 FOR PLAYGROUND EQUIPMENT AND OTHER PARK AMENITIES AT LEYDEN PARK AND AUTHORIZATION OF THE EXPENDITURE THEREOF City Attorney Bob Gehler read the title of Ordinance 1737: AN ORDINANCE AMENDING THE 2008 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO BY THE RECOGNITION OF THE NATIONAL RECREATION AND PARKS ASSOCIATION GRANT IN THE AMOUNT OF $500 FOR DEVELOPING A RECREATIONAL FISHING PROGRAM IN THE COMMUNITY AND AUTHORIZATION OF THE EXPENDITURE THEREOF

EXECUTIVE SESSION
Council members McEldowney and Johnson moved and seconded to go into an executive session for a conference with the City Attorney for the purpose of receiving legal advice on specific legal questions regarding election issues under C.R.S. 24-6-402(4)(b)
VOICE VOTE: Unanimous; all present affirmed
Council reconvened the regular meeting at 8:25 p.m.
RESOLUTIONS
Resolution 2008-33 Council members McEldowney and Johnson moved and seconded to approve Resolution 2008-33 Council members Drotar and Teter moved and seconded allowing Councilman Benson to abstain from voting on the resolution. VOICE VOTE ON SECOND MOTION : 8 aye, 1 abstain (Benson) City Attorney Bob Gehler read the title of Resolution 2008-33: RESOLUTION ADOPTING A “POSITION OF NO SUPPORT” REGARDING AN INITIATIVE PETITION REQUIRING AN ELECTION FOR AN ORDINANCE IMPOSING AN ADMISSIONS TAX IN COMMERCE CITY
VOICE VOTE: 8 aye, 1 abstain (Benson)
Resolution 2008-34
Council members McEldowney and Teter moved and seconded to approve Resolution 2008-34
City Attorney Bob Gehler read the title of Resolution 2008-34: RESOLUTION APPROVING EASEMENT TO CONSTRUCT AND MAINTAIN SANITARY SEWER AND STORM SEWER ON CITY PROPERTY TO SOUTH ADAMS COUNTY WATER AND SANITATION DISTRICT VOICE VOTE: Unanimous; all present affirmed

Council members Johnson and Snyder moved and seconded to approve Resolution 2008-35
City Attorney Bob Gehler read the title of Resolution 2008-35: RESOLUTION APPROVING EASEMENT TO CONSTRUCT AND MAINTAIN SANITARY SEWER AND STORM SEWER ON CITY PROPERTY TO OPEN DOOR FELLOWSHIP CHURCH
VOICE VOTE: Unanimous; all present affirmed
ORDINANCES ON FIRST READING
Ordinance 1740
Council members Johnson and Snyder moved and seconded introduction of Ordinance 1740 by Council as seated and approval of the ordinance on first reading.
City Attorney Bob Gehler read the title of Ordinance 1740: AN ORDINANCE AMENDING THE 2008 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO BY THE RECOGNITION OF THE GOCO LOCAL PARKS AND OUTDOOR RECREATION PROGRAM GRANT IN THE AMOUNT OF $200,000 FOR THE PRAIRIE GATEWAY OPEN SPACE PERIMETER TRAIL AND AUTHORIZATION OF THE EXPENDITURE THEREOF

ORDINANCES ON SECOND READING
Ordinance 1726
Council members Teter and Drotar moved and seconded to approve Ordinance 1726 on second and reading. Councilman Benson moved to make the ordinance comply with the summary statement given. The motion to amend the second reading of Ordinance 1726 died for lack of a second. Council members McEldowney and Teter moved and seconded to approve Ordinance 1726 on second reading as drafted. City Attorney Bob Gehler read the title of Ordinance 1726: AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF COMMERCE CITY BY ADDING THERETO A NEW SECTION 13-16 REGARDING RESTRICTIONS ON THE BLOCKING OF PUBLIC STREETS OR SIDEWALKS AND RENUMBERING TO SECTION 13-17 EXISTING SECTION 13-16
ROLL CALL VOTE: 5 aye, 4 nay (Johnson, Lewis, Benson, Jaquith)
Council members Lewis, Johnson, and Benson asked to have their names removed from the introduction of the ordinance.
