CALL TO ORDER

 

A regular meeting of the City Council of the City of Commerce City was called to order by Mayor Paul Natale on July 7, 2008, at 7:10 p.m.

PRESENTATIONS & PROCLAMATIONS

 

Plaque Presentation to Councilwoman Drotar

 

Mayor Natale presented Councilwoman Drotar with a plaque in recognition for her service to the community as a civic leader and her tenure as Mayor Pro-Tem from November 2007 to June 2008.

 


 

Certificate of Achievement for Excellence in Financial Reporting

 

Mayor Natale presented Finance Director Roger Tinklenberg with a certificate of achievement for excellence in financial reporting for the Comprehensive Annual Financial Report of the fiscal year ending December 2006.  The certificate is presented to the City by the Government Finance Officers Association.

APPROVAL OF MINUTES

 

Council members Lewis and McEldowney moved and seconded allowing Councilwoman Drotar to abstain from voting on the minutes of the regular meeting of June 16, 2008, because of her excused absence.

VOICE VOTE:  7 aye, 1 abstain (Drotar)

 

Council members Lewis and McEldowney moved and seconded approving the minutes of the study session of June 9, 2008.

VOICE VOTE:  Unanimous; all present affirmed

 

Council members McEldowney and Jaquith moved and seconded approving the minutes of the regular meeting of June 16, 2008

VOICE VOTE:  7 aye, 1 abstain (Drotar)

 

CITIZEN COMMUNICATION

 

Joy Bishop, no address provided, reported on fireworks going off in her neighborhood.

 

Trudy Smith, 7142 Pontiac Street, asked audience members who are in support of curbside recycling to stand.  Ms. Smith stated that Commerce City Citizens for Recycling support free trash and recycling services for all Commerce City households and encouraged Council to review a “Pay as You Throw” component in future trash service contracts.

Robert Romine, 6760 E. 74th Ave., thanked Council for their interaction with the water board to get the streets in the Derby area repaired.

Josh Russell, Executive Director of Archdiocese Housing, talked about a proposed housing project in the city that would serve low to moderate-income disabled adults

Patty Murray, 16550 116th Ct., expressed her displeasure over an elected official sending and receiving test messages during a NCC meeting.

Steve Douglas, 10970 Unity Parkway, asked for parking areas and safety features along the new bike/pedestrian trail.  He also requested a residency check on the city’s boards and commissions.

 

Jeanette Lewis, 5680 E. 67th Ave., presented Council with a petition for a speed bump on East 67th Avenue between Holly and Kearney.

Janice Drake 5641 E. 67th Ave., spoke in support of the petition for a speed bump on her street to slow traffic down.

Shirley Curless, 5721 E. 67th Ave., spoke in support of the petition for a speed bump on her street to slow traffic down.

Kristi  Douglas, 10970 Unity Parkway, spoke on behalf of the Housing Authority regarding the proposed housing project mentioned by Mr. Russell.  She also asked the community to join her and her husband to pull weeds along Quebec Parkway.

ADDITIONAL MOTIONS

Council members Drotar and Benson moved and seconded sending a letter from City Council to HUD in support of a future housing project by the Archdiocese of Denver.

CONSENT AGENDA

Council members McEldowney and Snyder moved and seconded approving the consent agenda as presented.

 

City Attorney Bob Gehler read the title of Ordinance 1733: AN ORDINANCE AMENDING THE 2008 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO BY THE RECOGNITION OF THE DONATION FROM THE SAND CREEK REGIONAL GREENWAY PARTNERSHIP IN THE AMOUNT OF $9,385 FOR EQUIPMENT USED AT DAHLIA TRAILHEAD AND INSTALLATION OF A TABLE AND SHELTER ADJACENT TO SAND CREEK TRAIL AND AUTHORIZATION OF THE EXPENDITURE THEREOF

 

City Attorney Bob Gehler read the title of Ordinance 1734: AN ORDINANCE AMENDING THE 2008 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO BY TRANSFERRING A PORTION OF THE BUDGET IN THE STREET AND BRIDGE FUND TO THE GENERAL FUND FOR BENEFITS ASSOCIATED WITH THE NEW OPERATIONS TECHNICIAN POSITIONS IN THE AMOUNT OF $36,786 AND AUTHORIZING THE EXPENDITURE THEREOF


 

City Attorney Bob Gehler read the title of Resolution 2008-31: RESOLUTION REGARDING INTERGOVERNMENTAL AGREEMENT WITH THE CITY AND COUNTY OF DENVER FOR THE PROVISION OF LAW ENFORCEMENT SERVICES AND AID IN PREPARATION FOR AND DURING THE 2008 DEMOCRATIC NATIONAL CONVENTION

RESOLUTIONS

 

Resolution 2008-28

Human Resource Director Heather Olson addressed Council and explained the contributions of the city toward the promotion of public health.

Council members McEldowney and Johnson moved and seconded to approve Resolution

2008-28

City Attorney Bob Gehler read the title of Resolution 2008-28:  RESOLUTION APPROVING A MEMORANDUM OF UNDERSTANDING FOR PROMOTION OF PUBLIC HEALTH

 

VOICE VOTE:  Unanimous; all present affirmed

 

Resolution 2008-29

 

Customer Service Coordinator Toby Maez gave a PowerPoint presentation on a partnership between the City and Family Tree by providing a link on our website to the Family Tree Military Assistance Program website.

Suzy MacKenzie, Director, Adams County Projects Military Family Assistance, gave a brief description of the program.

Council members Benson and Lewis moved and seconded to approve Resolution 2008-29.

 

City Attorney Bob Gehler read the title of Resolution 2008-29RESOLUTION DECLARING THE CITY OF COMMERCE CITY MILITARY FAMILY FRIENDLY AND ENCOURAGING AREA BUSINESSES TO BECOME A MILITARY FAMILY FRIENDLY PARTNER

 

VOICE VOTE:  Unanimous; all present affirmed

ORDINANCES ON FIRST READING

 

Ordinance 1738

 

Council members McEldowney and Jaquith moved and seconded introduction of Ordinance 1738 by Council as seated and approval of the ordinance on first reading.

City Attorney Bob Gehler read the title of Ordinance 1738: AN ORDINANCE AMENDING THE 2008 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO, BY APPROPRIATING A PORTION OF THE UNENCUMBERED FUND BALANCE OF THE GENERAL FUND IN THE AMOUNT OF $30,000 TO BE USED FOR AN AGREED UPON PROCEDURES AUDIT OF PROCUREMENT CARD PURCHASES AND TRAVEL EXPENSES AND AUTHORIZING THE  EXPENDITURE THEREOF

Council members McEldowney and Snyder moved and seconded introduction of Ordinance 1739 by Council as seated and approval of the ordinance on first reading.

City Attorney Bob Gehler read the title of Ordinance 1739: AN ORDINANCE AMENDING THE 2008 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO BY THE RECOGNITION OF THE COLORADO DEPARTMENT OF EMERGENCY MANAGEMENT GRANT IN AN AMOUNT UP TO $43,760 FOR THE SUPPORT OF THE EMERGENCY MANAGEMENT DIVISION AND AUTHORIZATION OF THE EXPENDITURE THEREOF

ROLL CALL VOTE:  8 aye

 

REPORTS

 

Council members McEldowney and Lewis moved to allow Councilman Benson to abstain from voting on a motion to direct staff to draft a resolution advocating no support of an initiative petition drive in current circulation throughout the city.

VOICE VOTE:  7 aye, 1 abstain (Benson)

Council members McEldowney and Snyder moved and seconded to direct staff to draft a resolution advocating no support of an initiated petition drive for an ordinance imposing an admissions tax.

ROLL CALL VOTE:  6 aye, 1 nay (Lewis), 1 abstain (Benson)
