MINUTES REGULAR MEETING OF COMMERCE CITY COUNCIL May 19, 2008 CALL TO ORDER A regular meeting of the City Council of the City of Commerce City was called to order by Mayor Paul Natale on May 19, 2008, at 7:00 p.m. ROLL CALL Present: Mayor Natale- presiding Mayor Pro-Tem Drotar Councilman Benson Councilman Jaquith Councilman Johnson Councilman Lewis Councilman McEldowney Excused: Councilwoman Snyder Councilwoman Teter Staff Reporting: City Attorney Robert Gehler City Manager Jerry Flannery Community Development Director Brian McBroom PLEDGE OF ALLEGIANCE The Pledge of Allegiance was recited. APPROVAL OF MINUTES Council members McEldowney and Benson moved and seconded approving the minutes of the regular meeting of May 5, 2008. VOICE VOTE: Unanimous; all present affirmed Community Planning Director Brian McBroom introduced the new Building Official, Patrick Buckley. PRESENTATIONS Council members Drotar and McEldowney moved and seconded postponing the recognition of Officer Brandon Zborowski for his service to the community until June 2, 2008, and the Kids Helping Kids Presentation by Peter Montoya until July 21, 2008. VOICE VOTE: Unanimous; all present affirmed The City Council recognized Roger Tinklenberg for his work as Acting Deputy City Manager.
The City Council recognized Carol Enninga for her work as Acting Finance Director.
SWEARING IN CEREMONY Council members McEldowney and Johnson moved and seconded appointment of Assistant City Attorney Karen Stevens. VOICE VOTE: Unanimous; all present affirmed Deputy City Clerk Suzy Schares administered the Oath of Office to Assistant City Attorney Stevens. CITIZEN COMMUNICATION Gene Leffel, 6530 Brighton Rd., reported that the CARZ Club did a property clean up and he wanted to thank the Neighborhood Services Inspector David Lutter for assisting in the clean up. Ron Girard, 16405 E. 117th Ave., expressed concerns with the issuance of violations by Neighborhood Services and the lack of upkeep on the property between their subdivision and the golf course. Sally McIntosh, Ellen Sweet, Alice Applehans, with the Monaco Improvement Group, expressed concerns with code enforcement on Monaco and with the graffiti being placed on their property. CONSENT AGENDA Council member Drotar requested that Resolution 2008-15 be removed from consent. Council members McEldowney and Benson moved and seconded approving the consent agenda as presented without Resolution 2008-15. City Attorney Bob Gehler read the title of Ordinance 1721: AN ORDINANCE AMENDING THE 2008 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO, BY APPROPRIATING A PORTION OF THE UNENCUMBERED FUND BALANCE OF THE GENERAL FUND IN THE AMOUNT OF $244,992 AND TRANSFERRING A PORTION OF THE UNENCUMBERED FUND BALANCE IN THE GENERAL FUND TO THE FLEET MANAGEMENT FUND IN THE AMOUNT OF $126,000 FOR A TOTAL AMOUNT OF $370,992 AND REAFFIRMING PRIOR APPROPRIATIONS AND AUTHORIZING THE EXPENDITURE THEREOF City Attorney Bob Gehler read the title of Ordinance 1728: AN ORDINANCE AMENDING THE 2008 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO BY TRANSFERRING A PORTION OF THE UNENCUMBERED FUND BALANCE IN THE PARKS AND RECREATION CAPITAL PROJECT FUND IN THE AMOUNT OF $4,667.29 TO THE LOTTERY FUND City Attorney Bob Gehler read the title of Ordinance 1729: AN ORDINANCE AMENDING THE 2008 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO BY REAFFIRMING PRIOR APPROPRIATIONS IN THE POLICE DONATION FUND IN THE AMOUNT OF $21,237.54 FOR THE SUPPORT OF MISCELLANEOUS PROGRAMS AND THE AUTHORIZATION OF THE EXPENDITURE THEREOF City Attorney Bob Gehler read the title of Ordinance 1730: AN ORDINANCE AMENDING THE 2008 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO, BY TRANSFERRING THE UNENCUMBERED FUND BALANCE IN THE AMOUNT OF $71,049.49 AND ANY ACCRUED INTEREST IN THE CASH IN LIEU FUND TO THE IMPACT FEE FUND AND AUTHORIZATION OF THE EXPENDITURE THEREOF City Attorney Bob Gehler read the title of Resolution 2008-25: RESOLUTION EXPRESSING INTENT TO PROCEED WITH THE PROCESS FOR ACQUIRING A PORTION OF STATE HIGHWAY 44 (104TH AVENUE) FOR A CITY ROADWAY ROLL CALL VOTE: 7 ayes Council members Johnson and Benson moved and seconded approval of Resolution 2008-15. City Attorney Bob Gehler read the title of Resolution 2008-15: RESOLUTION AUTHORIZING CONTRACT FOR CONSULTANT REGARDING CITY COUNCIL ADVANCES AND ASSIGNMENTS ROLL CALL VOTE: 6 ayes, 1 nay (Drotar) ORDINANCES ON FIRST READING Ordinance 1731 Council members Benson and Johnson moved and seconded introduction of Ordinance 1731 by Council as seated and approval of the ordinance on first reading. City Attorney Bob Gehler read the title of Ordinance 1731: AN ORDINANCE RENAMING THE COMMUNITY PLANNING AND DEVELOPMENT SERVICES DEPARTMENT TO THE “COMMUNITY DEVELOPMENT DEPARTMENT” ROLL CALL VOTE: 7 ayes Ordinance 1732 Council members Lewis and Johnson moved and seconded introduction of Ordinance 1732 by Council as seated and approval of the ordinance on first reading. City Attorney Bob Gehler read the title of Ordinance 1732: AN ORDINANCE AMENDING THE 2008 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO, BY APPROPRIATING A PORTION OF THE UNENCUMBERED FUND BALANCE OF THE GENERAL FUND IN THE AMOUNT OF $36,000 TO BE USED FOR ANIMAL SHELTER SERVICES AND AUTHORIZING THE EXPENDITURE THEREOF ROLL CALL VOTE: 7 ayes ORDINANCES ON SECOND READING Ordinance 1726 Council members McEldowney and Benson moved and seconded to approve Ordinance 1726 on second and final reading. Councilman McEldowney retracted motion. Council members Jaquith and Benson moved and seconded to continue Ordinance 1726 until all of Council is in attendance. VOICE VOTE: Unanimous; all present affirmed REPORTS Council expressed gratitude for a successful Golf Tournament. Concern was expressed regarding consultant fees and a full accounting of the Derby project was requested.
