MINUTES REGULAR MEETING OF COMMERCE CITY COUNCIL April 21, 2008 CALL TO ORDER A regular meeting of the City Council of the City of Commerce City was called to order by Acting Mayor Tracey Snyder on April 21, 2008, at 7:00 p.m. ROLL CALL Present: Councilman Benson Councilman Jaquith Councilman Johnson Councilman Lewis Councilman McEldowney Councilwoman Snyder Councilwoman Teter Absent: Mayor Natale, presiding Mayor Pro-Tem Drotar Staff Reporting: City Attorney Robert Gehler City Manager Jerry Flannery Commander Larry Woog Acting Finance Director Carol Enninga PLEDGE OF ALLEGIANCE The Pledge of Allegiance was recited. PRESENTATIONS & PROCLAMATIONS Re-appointment and Swearing in of Municipal Court Judge David Juarez Council members McEldowney and Benson moved and seconded re-appointment of Municipal Court Judge David Juarez VOICE VOTE: Unanimous; all present affirmed City Clerk Laura Bauer administered the Oath of Office to Judge Juarez Judge Juarez gave a brief State of the Municipal Court address to Council. ADDITIONAL MOTIONS Council members Benson and Teter moved and seconded to re-appoint Judge Juarez again in November 2009 to coincide with City Council new terms. VOICE VOTE: Unanimous; all present affirmed Recognizing Certain Staff Members of Community Development City Council recognized Planning Manager Chris Cramer, Planners Steve Timms and Jenny Axmacher, and Administrative Supervisor Lysa Gallegos for their work with the Northern Enclave Annexation Proclamation – National Day of Prayer Council members Johnson and McEldowney moved and seconded proclaiming Thursday, May 1, 2008, as a city-wide day of prayer. VOICE VOTE: Unanimous; all present affirmed APPROVAL OF MINUTES Council members McEldowney and Johnson moved and seconded approving the minutes of the study session of March 24, 2008. VOICE VOTE: Unanimous; all present affirmed Council members McEldowney and Jaquith moved and seconded approving the minutes of the regular meeting of April 7, 2008. VOICE VOTE: Unanimous; all present affirmed ADDITIONAL MOTIONS Council Members Johnson and Teter moved and seconded to excuse the absence of Mayor Natale and Mayor Pro-Tem Drotar. VOICE VOTE: Unanimous; all present affirmed CITIZEN COMMUNICATION Gene Leffel, 6530 Brighton Blvd., thanked everyone for attending a recent candidate forum for the South Adams County Water & Sanitation District sponsored by the CARZ Club. Glen Murray, 11010 Havana St., reported being a victim of vandalism at his property and asked for the City’s assistance. CONSENT AGENDA Council members Jaquith and McEldowney moved and seconded approving the consent agenda as presented City Attorney Bob Gehler read the title of Ordinance 1713: AN ORDINANCE AMENDING THE 2008 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO BY THE RECOGNITION OF THE VALE GRANT IN THE AMOUNT OF $1,800 FOR THE SUPPORT OF THE VICTIM SERVICES PROGRAM AND THE AUTHORIZATION OF THE EXPENDITURE THEREOF City Attorney Bob Gehler read the title of Ordinance 1715: AN ORDINANCE AMENDING THE 2008 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO BY THE RECOGNITION OF THE HEALTHY SCHOOLS PARTNERSHIP GRANT IN THE AMOUNT OF $50,000 FOR AFTER SCHOOL RECREATIONAL OPPORTUNITIES FOR TEENS AND THE AUTHORIZATION OF THE EXPENDITURE THEREOF City Attorney Bob Gehler read the title of Ordinance 1718: AN ORDINANCE AMENDING THE 2008 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO BY THE RECOGNITION OF THE PRAIRIE GATEWAY SHUTTLE STUDY GRANT IN THE AMOUNT OF $40,000 FOR THE SHUTTLE FEASIBILITY STUDY OF THE WILDLIFE REFUGE/COMMERCE CITY/STAPLETON AREA AND THE AUTHORIZATION OF THE EXPENDITURE THEREOF City Attorney Bob Gehler read the title of Ordinance 1719: AN ORDINANCE AMENDING THE 2008 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO BY THE RECOGNITION OF THE COLORADO DEPARTMENT OF TRANSPORTATION GRANT (LEAF PROGRAM) IN THE AMOUNT OF $15,000 FOR (DUI) ENFORCEMENT EFFORTS AND THE AUTHORIZATION OF THE EXPENDITURE THEREOF City Attorney Bob Gehler read the title of Ordinance 1723: AN ORDINANCE AMENDING THE 2008 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO BY THE RECOGNITION OF THE COLORADO DEPARTMENT OF TRANSPORTATION GRANT IN THE AMOUNT OF $4,800 FOR THE POLICE SEATBELT ENFORCEMENT OF THE CLICK IT OR TICKET PROGRAM AND AUTHORIZATION OF THE EXPENDITURE THEREOF City Attorney Bob Gehler read the title of Ordinance 1724: AN ORDINANCE AMENDING THE 2008 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO BY THE RECOGNITION OF THE ADAMS COUNTY OPEN SPACE GRANT IN THE AMOUNT OF $45,000 TO OFFSET COSTS FOR THE GOTO PROPERTY LOCATED AT 6019 FOREST DRIVE IN COMMERCE CITY AND AUTHORIZATION OF THE EXPENDITURE THEREOF City Attorney Bob Gehler read the title of Ordinance 1725: AN ORDINANCE AMENDING THE 2008 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO BY THE RECOGNITION OF THE DRCOG GRANT IN THE AMOUNT OF $166,500 FOR TRAFFIC SIGNAL SYSTEM PURCHASES FOR USE ON HIGHWAY 2 AT 104TH AVENUE AND 86TH AVENUE AND AUTHORIZATION OF THE EXPENDITURE THEREOF City Attorney Bob Gehler read the title of Resolution 2008-14: RESOLUTION APPROVING CONVEYANCE OF CITY PROPERTY KNOWN AS TRACT U, VILLAGES AT FRONTERRA FILING NO. 1, TO BRIGHTON PUBLIC SCHOOL DISTRICT 27-J ROLL CALL VOTE: 7 aye ORDINANCES ON FIRST READING Ordinance 1726 Council asked Commander Woog of the police department to come forward and address their concerns. Council members Teter and Benson moved and seconded introduction of Ordinance 1726 by Council as seated and approval of the ordinance on first reading. City Attorney Bob Gehler read the title of Ordinance 1726: AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF COMMERCE CITY BY ADDING THERETO A NEW SECTION 13-16 REGARDING RESTRICTIONS ON THE BLOCKING OF PUBLIC STREETS OR SIDEWALKS AND RENUMBERING TO SECTION 13-17 EXISTING SECTION 13-16. ROLL CALL VOTE: 5 aye, 2 nay (Jaquith, Johnson) Ordinance 1728 Council members McEldowney and Teter moved and seconded introduction of Ordinance 1728 by Council as seated and approval of the ordinance on first reading. City Attorney Bob Gehler read the title of Ordinance 1728: AN ORDINANCE AMENDING THE 2008 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO BY TRANSFERRING A PORTION OF THE UNENCUMBERED FUND BALANCE IN THE PARKS AND RECREATION CAPITAL PROJECT FUND IN THE AMOUNT OF $4,667.29 TO THE LOTTERY FUND Acting Finance Director Carol Enninga came forward and answered Council’s questions regarding this ordinance. City Attorney Bob Gehler read the title of Ordinance 1729: AN ORDINANCE AMENDING THE 2008 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO BY REAFFIRMING PRIOR APPROPRIATIONS IN THE POLICE DONATION FUND IN THE AMOUNT OF $21,237.54 FOR THE SUPPORT OF MISCELLANEOUS PROGRAMS AND THE AUTHORIZATION OF THE EXPENDITURE THEREOF

City Attorney Bob Gehler read the title of Ordinance 1730: AN ORDINANCE AMENDING THE 2008 BUDGET OF THE CITY OF COMMERCE CITY, COLORADO, BY TRANSFERRING THE UNENCUMBERED FUND BALANCE IN THE AMOUNT OF $71,049.49 AND ANY ACCRUED INTEREST IN THE CASH IN LIEU FUND TO THE IMPACT FEE FUND AND AUTHORIZATION OF THE EXPENDITURE THEREOF ROLL CALL VOTE: 7 aye REPORTS None.
