Commercial Construction

The planning requirements for a project depend on the property’s zoning. Use our interactive map service to look up a property’s zoning designation. This map will only provide information on a property’s zoning designation. A specific property may have conditions or restrictions associated with it that could affect development on the property. Contact the planner of the day to determine whether or not a property has restrictions.

General Requirements
Is your project one of the following types of development?
  • Any commercial or industrial use on a vacant lot
  • Commercial or industrial additions that are 5,000 square feet or larger in size
  • Commercial or industrial additions that constitute more than 50% of the existing floor area of a building
  • Any mobile home park
  • Any development where more than one principal building will be sited on a single lot
  • Any development including a residence and one or more nonresidential uses
  • Any multi-family dwelling
  • Any civic or institutional use, except for the following:
  • Forest or range land
  • Public lands, parks, and buildings
  • Minor public utilities
  • Any substantial change in use of a property that results in special circumstances or impacts on the area, as determined by the city

A development plan review or Planned Unit Development (PUD) Development Permit review is required before a building permit can be issued.

Derby Sub Area or Zoned PUD-Derby
Is your project located in the Derby Sub area or zoned PUD-Derby?
  • The Derby Sub-Area is a triangular area bounded by 72nd Avenue on the south side, Highway 2 on the west and north sides, and Magnolia Street on the east side.

If so, you will need the Derby Design Review Information.

Remodels
If you are changing uses, please confirm that the new use is allowed in the property’s zone district. The Land Development Code's Land Use Table, describes all of the allowed uses in each zone district.

Changes in use or building expansion may require compliance with additional codes, such as landscaping, parking or design standards. Contact the planner of the day for additional information.

Additions
Commercial or industrial additions that are 5,000-square-feet or larger in size or constitute more than 50% of the existing floor area of a building may require a development plan review.
